When working with a real estate professional, it's important
to decide if you will be the customer or the client.
A Customer receives valuable services from the real estate brokerage such as
assistance and information, but is not represented by that brokerage. If you
do not sign a written contract, you are not a client, but a customer. As
a customer, do NOT expect the real estate professional to keep your
bargaining information confidential. Whenever you, as a customer, speak to
a real estate professional that represents another party in a purchase or sale,
assume you are talking directly to the other party (buyer or seller).
A Client is a buyer or seller who has signed a written contract to be
"represented" by a broker. If there is no written agreement you
are not a client.
WHAT CAN YOU EXPECT AS A CLIENT?
You can expect the real estate professional to:
- keep information about your bargaining position completely confidential
in the market place.
- reasonably act to negotiate the best price and terms for you.
- provide important information the agent knows or should reasonably
have known which would influence your decision to buy or sell.
- promote your interests with good faith, honesty, and fair dealing
and use reasonable skill and care in business dealings with you.

In the past, the only person represented in a real estate transaction
was the seller. Now, it is possible for the buyer to have representation
through the use of a Buyer's Broker. The buyer, who chooses to be
represented by a buyer's broker, enters into a formal agreement with the
broker to locate and negotiate the purchase of a property. And the best
part is there is no cost to the buyer! The buyer's broker typically receives
compensation out of the seller's funds at closing. For more information,
